Terms of Service

1. Acceptance of these Terms

By creating an account, purchasing a subscription, or using Boonly, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service. If you use Boonly for a business or organization, you represent that you have authority to bind it to these Terms.

2. Eligibility

You must have the legal capacity to enter into a binding agreement and may use Boonly only in compliance with applicable law. Boonly is a business service and is not directed to children. You may not use the service if applicable law prohibits you from doing so.

3. Accounts and authentication

You may register with email and password or use optional Google authentication through Supabase Auth. You must provide accurate account information, keep your credentials secure, and promptly notify us of suspected unauthorized access. You are responsible for activity under your account unless caused by Boonly’s breach of these Terms or applicable law.

Where supported, Supabase may connect an authorized Google identity to an account associated with the same verified email. Do not attempt to access another person’s account or misrepresent your identity or authority.

4. What Boonly provides

Boonly is a funding find discovery and intelligence platform. It helps customers discover published grants, reimbursements, incentives, cash awards, and related funding finds; maintain an optional business profile; receive personalized matching information; save finds; and manage alerts and digests.

5. Funding Find Disclaimer

Boonly does not provide grants, make funding decisions, guarantee eligibility, guarantee application success, or guarantee that a customer will receive funding.

Find information can change. You are responsible for reviewing the original funding provider’s current requirements, deadlines, eligibility rules, terms, and application materials before relying on or applying for a find.

Boonly may link to third-party websites where you can learn more or apply. Boonly is not responsible for the availability, accuracy, policies, decisions, or conduct of independent third-party funding providers.

Personalized matches, match statuses or scores, Hidden Scores, labels, recommendations, explanations, alerts, and other Boonly intelligence are informational tools only. They are not legal, financial, tax, investment, or other professional advice.

6. Subscriptions and billing

Boonly offers The Boon as a monthly or annual paid membership. Prices and included features are displayed before purchase. Subscriptions are processed by Stripe and renew automatically at the applicable billing interval until canceled. You authorize Stripe to charge your selected payment method for recurring fees and applicable taxes.

You may manage or end your membership through the Stripe Customer Portal available from Boonly. Unless stated otherwise during checkout, cancellation stops future renewal and paid access continues through the end of the current paid billing period. Canceling does not automatically delete your Boonly account or profile information.

Payments are non-refundable and Boonly does not provide credits or prorated refunds for partially used billing periods, except where required by applicable law or expressly stated at the time of purchase. If a payment fails, access may be limited or suspended in accordance with the subscription status reported by Stripe.

7. Acceptable use

You agree not to:

• Use Boonly unlawfully, fraudulently, deceptively, or to harm others.
• Access or attempt to access another customer’s account or nonpublic data.
• Probe, bypass, disable, or interfere with security, access controls, rate limits, or service operation.
• Introduce malicious code, automate abusive requests, scrape the service in violation of these Terms, or overload infrastructure.
• Copy, resell, sublicense, or commercially exploit the service or its compiled find intelligence except as expressly permitted.
• Use Boonly to violate intellectual-property, privacy, publicity, or other rights.
• Misrepresent Boonly information as an official decision or guarantee from a funding provider.

8. Intellectual property

Boonly and its software, design, branding, organization, and original content are owned by Boonly Organization or its licensors and are protected by applicable laws. Subject to these Terms, Boonly grants you a limited, revocable, nonexclusive, nontransferable right to use the service for your own lawful business purposes. Third-party funding materials remain subject to their owners’ rights.

9. Information you submit

You retain ownership of information you submit. You grant Boonly permission to host, process, reproduce, and use that information only as reasonably necessary to operate, secure, personalize, and improve the service and fulfill these Terms. You represent that you have the right to submit the information and that doing so does not violate law or another person’s rights.

10. Third-party services and sources

Boonly uses third-party services such as Supabase, Google, Stripe, SendGrid, hosting and infrastructure providers, and may display or link to information from independent funding sources. Third-party services and websites are governed by their own terms and policies. A link or reference does not mean Boonly controls, endorses, or guarantees the third party.

11. Availability and changes

We work to provide a useful and reliable service, but Boonly may occasionally be unavailable, delayed, incomplete, or affected by third-party systems. We may modify, add, suspend, or discontinue features and may correct or remove find information. We do not promise uninterrupted access or that every find will be discovered, current, or available.

12. Suspension and termination

You may stop using Boonly and cancel a paid subscription at any time. We may restrict, suspend, or terminate access if you violate these Terms, create legal or security risk, fail to pay applicable fees, or misuse the service. Where reasonably practical, we will provide notice. Provisions that by their nature should survive termination, including ownership, disclaimers, liability limits, indemnification, and dispute terms, will survive.

13. Disclaimers

To the maximum extent permitted by law, Boonly is provided “as is” and “as available.” Boonly disclaims implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. We do not warrant that the service or find information will be uninterrupted, error-free, complete, current, or suitable for your particular circumstances. Nothing in these Terms excludes a warranty that cannot lawfully be excluded.

14. Limitation of liability

To the maximum extent permitted by law, Boonly Organization and its officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, business prospects, funding, or goodwill arising from or related to the service.

To the maximum extent permitted by law, Boonly’s aggregate liability arising from or related to the service will not exceed the greater of the amount you paid to Boonly during the twelve months before the event giving rise to the claim or $100. These limits do not apply where liability cannot lawfully be limited.

15. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Boonly Organization and its officers, employees, and contractors from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful misuse of Boonly, your violation of these Terms, or information you submit that infringes another person’s rights.

16. Governing law and disputes

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Any dispute will be brought in a court of competent jurisdiction, unless applicable law requires otherwise. Before filing a formal claim, you and Boonly agree to make a good-faith effort to resolve the issue by contacting the other party. Nothing here limits rights that cannot be waived under applicable law.

17. Changes to these Terms

We may update these Terms as the service or legal requirements change. We will post the revised Terms and update the effective date. If a change is material, we may provide additional notice. Continuing to use Boonly after revised Terms take effect means you accept them, to the extent permitted by law.
